Terms and Conditions for Bolo Fitness

1. Agreement to Terms
Welcome to Bolo Fitness! These Terms and Conditions ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you” or "user"), and Bolo Fitness (“we,” “us,” or “our”), concerning your access to and use of the bolofitness.co.za website as well as any related services, including physical gym access, personal training, group classes, and the sale of goods (collectively, the “Services”).
By accessing or using our Services, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these terms, then you are expressly prohibited from using the Services and you must discontinue use immediately.
2. User Accounts
To access certain features of our Services, such as booking classes or purchasing products, you may be required to register for an account. You agree to provide true, accurate, current, and complete information about yourself. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.
3. Health, Safety, and Assumption of Risk
This section is critically important. Please read it carefully.

Consult Your Physician: You acknowledge that physical exercise can be strenuous and carries inherent risks of injury. You are strongly advised to consult with a physician before beginning any new fitness or exercise program, or if you have a pre-existing medical condition.

Assumption of Risk: You understand and voluntarily accept full responsibility for all risks associated with using our gym facilities, equipment, and services, including but not limited to, slips, falls, equipment malfunction, and injuries resulting from physical exertion.

Waiver and Release of Liability: To the fullest extent permitted by law, you hereby release, waive, and discharge Bolo Fitness, its owners, employees, and agents from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by you while using any of our Services.
4. Gym Membership and Facility Use

Eligibility: You must be at least 18 years of age to purchase a membership and use our facilities, unless otherwise permitted with parental/guardian consent and supervision.

Gym Rules: You agree to abide by all posted gym rules and etiquette guidelines. Failure to do so may result in the suspension or termination of your membership without a refund.

Termination: We reserve the right to suspend or terminate your membership and access to the Services at our sole discretion, without notice, for any conduct that we believe violates these Terms, is harmful to other users, or is otherwise detrimental to Bolo Fitness.
5. Class Bookings and Cancellation Policy

Booking: Classes can be booked through your user account on our website. A spot in a class is not guaranteed until a booking is confirmed.

Cancellation: If you need to cancel a booked class, you must do so at least 2 hours in advance. Failure to cancel within this timeframe or failure to attend a booked class (a "no-show") may result in a penalty or forfeiture of the class credit.
6. Sale of Goods (Supplements)

Products: We make every effort to display as accurately as possible the colours, features, specifications, and details of the products available on the website. All products are subject to availability, and we cannot guarantee that items will be in stock.

Pricing and Payment: All prices are listed in South African Rand (ZAR) and are subject to change. We accept payment through our third-party payment processor, Yoco. By making a purchase, you agree to abide by the terms and conditions of our payment processor.

Shipping and Returns: All sales are subject to our Shipping and Returns Policy, which is available on our website. Our policies are designed to be compliant with the Consumer Protection Act (CPA).
7. Intellectual Property Rights
The content on our website, including the text, graphics, photos, and the trademarks, service marks, and logos contained therein (the "Marks"), are owned by or licensed to Bolo Fitness and are subject to copyright and other intellectual property rights under South African and foreign laws. You agree not to copy, reproduce, distribute, or create derivative works from any content without our express written permission.
8. Limitation of Liability
In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the Services, even if we have been advised of the possibility of such damages.
9. Governing Law
These Terms and your use of the Services are governed by and construed in accordance with the laws of the Republic of South Africa applicable to agreements made and to be entirely performed within the Republic of South Africa, without regard to its conflict of law principles.
10. Changes to Terms
We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason. We will alert you about any changes by updating the “Last Updated” date of these Terms.
